14 days after the day on which the goods came into the physical possession of the consumer or a person, other than the carrier, identified by the consumer to take possession of the goods

 

Exercising the right to cancel

Under regulation 32 of the Consumer Contracts Regulations, in order to exercise the right to cancel, you, the consumer must inform, us,  the retailer of your decision. There are no specific requirements on how you demonstrate your decision to cancel, except that there must be a clear statement. Such a statement could be given by e-mail, by post or phone. However, the burden of proof for having exercised the right to cancel is on the consumer. The consumer could also use the model cancellation form found here below to inform us.

 

Refund

It is the policy of idelicatus.co.uk to ensure that all goods are supplied to our customers in perfect condition and that every possible precaution is taken to protect the integrity of the product that is sold.

 

Effects of cancellation

 

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and not later than –

(a) 14 days after the day we receive back from you any goods supplied, or

(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or

(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods

If you requested to begin the performance of services during the cancellation period, you shall pay us an amount which is in proportion to what has been performed until you have communicated us your cancellation from this contract, in comparison with the full coverage of the contract

 

The right to cancel does not apply to the following kind of contracts:

• Contracts for the supply of goods which are liable to deteriorate or expire rapidly.

• Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

• Contracts for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.

 

Return costs

You must send the goods back to the address found on the invoice, at your own cost, unless we delivered the item to you in error or the item is damaged or defective. In those cases we will bear the return cost.

 

Items damaged in transit

 If you take delivery of a package from us and the contents have been damaged in transit, we will exchange the damaged items without charge to you provided you return the damaged item(s) to us within 30 days of taking delivery.

 

Incorrect Items

If we have sent you an incorrect item, please notify our Customer Relations Department as soon as possible or within 30 days and return the incorrect item to us and specify the correct details in writing. If you would like us to replace the incorrect item with the item you ordered we will send you the correct item as soon as possible or alternatively we will refund the item once it has been returned. We will not charge you for the incorrect item and we must have the incorrect item returned before investigating.
